Issue 18: Grafton charter amendment — Clerk of Council and Director of Finance

Section 1. Clerk of Council Effective from and after January 1, 2028, the Council may appoint, by a majority vote of its current members, a person to serve as the Clerk of Council. The Clerk of Council shall serve at the pleasure of the Council and may be removed without cause by a majority vote of the current members of Council. The Clerk shall give notice of the Council meetings, keep the journal of its proceedings, authenticated by the Clerk's signature and recorded in full, in a book kept for the purpose, all ordinances and resolutions of Council and perform such other duties as shall be required by this Charter or by ordinance or resolution of the Council. Section 2. Director of Finance (A) Effective from and after January 1, 2028, the Mayor shall appoint a Director of Finance who shall take office upon confirmation by the Council by a majority vote of its members. The Director of Finance shall serve at the pleasure of the Mayor and the Council and may be suspended or removed from office by the Mayor with the consent of the Council granted by a majority vote of its members, or by the Council by a four-fifths vote without the consent of the Mayor. (B) The Director of Finance shall possess an accredited degree in finance or a minimum of five years full time professional work experience in finance. Work experience shall be evaluated by Council and must demonstrate sufficient financial management skills. (C) The Director of Finance shall serve the Mayor and the Council as financial advisor in connection with municipal affairs. The Director of Finance shall keep the financial records of the Municipality, exhibiting accurate statements of all monies received and expended, of all property owned by the Municipality, and of all taxes and assessments. The Director of Finance shall be custodian of all public money of the Municipality, shall keep and preserve such money in the place or places authorized by ordinance, and shall disburse the same as may be required by law or ordinance. The Director of Finance shall not allow the amount set aside for any appropriation to be overdrawn or drawn for any other purpose. The Director of Finance may examine and audit the accounts of all officers, employees, and departments of the Municipality. The Director of Finance may require evidence that the amount of any claim presented to the Director of Finance is due. (D) In the event of a vacancy in the office of Director of Finance, a successor shall be appointed in the same manner as provided in Division (A) of this Section in the case of an original appointment. The Mayor, with the approval of a majority of Council, may appoint an Acting Director of Finance if there is a vacancy, absence, or disability of the Director of Finance, which Acting Director of Finance shall serve at the pleasure of the Mayor and Council. The Acting Director of Finance shall exercise the powers, duties and functions of the Director of Finance under this Charter. Shall Article V, 1 and 2 of the Charter of Village of Grafton be amended as follows: Granting Council the authority to appoint a Clerk of Council and the Mayor to appoint a qualified Director of Finance.
