City of Nolanville Proposition A: charter amendment — deleting council wards
Shall Section 1.05 - Wards of the Nolanville Charter be deleted to remove provisions authorizing the creation of council wards and ward boundaries? If approved, this section will be deleted: 1. SECTION 1.05 - Wards The city council shall have the power to create wards or change the boundaries of wards so created, designating and describing same by metes and bounds or other adequate means, provided that at no time shall there be greater than four (4) wards and when created, each ward shall have as nearly as possible the same number of residents residing therein. The city council may, at its discretion, appoint a commission of citizens of the City to set and/or review the ward boundaries in order to maintain a substantial equality of residents in each district.
City of Nolanville Proposition B: charter amendment — residency requirement for candidates
Shall Section 3.03 - Qualifications of the Nolanville Charter be amended to require that candidates for Mayor or City Council have resided continuously within the corporate limits of the City for twelve (12) months immediately preceding the filing deadline for office, rather than the date of the election or appointment? If approved, Section 3.03 will read: SECTION 3.03 - Qualifications Have resided continuously in the corporate limits of the City for twelve (12) months immediately preceding the filing deadline.
City of Nolanville Proposition C: charter amendment — mayor's appointment of advisory boards
Shall Section 3.06 of the Nolanville Home Rule Charter be amended to remove the provision authorizing the Mayor, with the advice and consent of the City Council, to appoint members of citizen advisory boards and commissions in order to eliminate conflicting language within the Charter? If approved, Section 3.06 will read: SECTION 3.06 - Mayor The Mayor shall be the presiding officer of the City Council and shall be recognized as the head of the City government for all ceremonial purposes, for emergency management purposes, and by the governor for purposes of military law. The Mayor may debate and discuss any matters before the City Council and shall only vote on issues resulting in a tie by the City Council. The Mayor shall, when authorized as necessary by the City Council, sign all official documents. The Mayor shall have no veto power.
City of Nolanville Proposition D: charter amendment — excused and unexcused absences
Shall Section 3.08 - Vacancies; Forfeiture of Office; Filling of Vacancies of the Nolanville Charter be amended to clarify the process for determining whether three consecutive absences from regular City Council meetings are excused or unexcused prior to any forfeiture of office? If approved, the sections will read: SECTION 3.08 - Vacancies; Forfeiture of Office; Filling of Vacancies Fails to attend three consecutive regular meetings of the Council. Upon such occurrence, the matter shall be presented to the Council, which may, at its discretion, determine whether the absences are excused or unexcused and take appropriate action, including forfeiture of office.
City of Nolanville Proposition E: charter amendment — council as final authority on forfeiture
Shall Section 3.08 - Vacancies; Forfeiture of Office; Filling of Vacancies of the Nolanville Charter be amended to provide that the City Council shall be the final authority in determining whether a forfeiture of office has occurred and the effective date of that forfeiture? If approved, the sections will read: SECTION 3.08 - Vacancies; Forfeiture of Office; Filling of Vacancies The City Council shall be the final authroity in determining whether a forfeiture of office has occurred, including the effective date of such forfeiture.
City of Nolanville Proposition F: charter amendment — filling vacancies within 90 days
Shall Section 3.08 - Vacancies; Forfeiture of Office; Filling of Vacancies of the Nolanville Charter be amended to require the City Council to fill a vacancy in the office of Mayor or City Council within ninety (90) days and provide that the appointee shall serve until the next regular November municipal election, at which time a successor shall be elected to serve the remainder of the unexpired term, if any? If approved, this section will read: SECTION 3.08 - Vacancies; Forfeiture of Office; Filling of Vacancies When a vacancy occurs in the office of Mayor or City Council, the remaining members of the City Council shall appoint a qualified person to fill such vacancy within ninety (90) days of the occurrence of the vacancy. The appointee shall serve until the next regular municipal election held in November, at which time a successor shall be elected to serve the remainder of the unexpired term, if any. For purposes of this section, a vacancy shall be deemed to occur on the date the office is declared vacant in accordance with this Charter.
City of Nolanville Proposition G: charter amendment — term limits
Shall Section 3.09 - Prohibitions of the Nolanville Charter be amended to revise the term limit provisions by limiting an individual to four (4) two-year terms in any one elective office regardless of whether the terms are consecutive, while retaining separate term limits for each elective office? If approved, this section will read: SECTION 3.09 - Prohibitions Term Limits. No person shall serve for more than four (4) two (2) year terms in any one office. For purposes of this section: a. Service by appointment to fill a vacancy shall not be counted toward the term limits established herein. b. Term limits shall apply separately to each elective office. Service in one office shall not be counted toward the term limits of another office.
City of Nolanville Proposition H: charter amendment — publication of franchise ordinances
Shall Section 8.03 - Franchises of the Nolanville Charter be amended to remove the Charter requirement for publication of franchise ordinances in the City's official newspaper before such ordinances take effect? If approved, this section will read: SECTION 8.03 - Franchises Any ordinance granting, renewing or extending franchises shall not take effect until at least thirty (30) days after its passage.
City of Nolanville Proposition I: charter amendment — referendum timeline
Shall Section 9.13 - Referendum; Petition; Procedure; Effect Prior to Election of the Nolanville Charter be amended to revise the timeframe for the City Council to repeal or submit a referendum ordinance to the qualified voters from thirty (30) days to sixty (60) days, consistent with other provisions of the Charter? If approved, this section will read: SECTION 9.13 - Referendum; Petition; Procedure; Effect Prior to Election City Council shall either repeal the referendum ordinance or submit the referendum ordinance to the qualified voters of the City within sixty (60) days after the date the petition was finally determined sufficient, or at the next uniform election date, if a uniform election date does not exist within sixty (60) days after the petition is finally determined sufficient.
